TERMS AND CONDITIONS
Hourly Moving
The hourly rate begins when the moving vehicle and crew arrive at the point of origin of the contracted for move, and ends when all of the goods are unloaded at the point of destination, less any scheduled breaks and/or any vehicular breakdown, plus any applicable travel time. The standard hourly rate is from Monday through Friday, from 8:00AM to 5:00PM. The overtime hourly rate is any time in excess of the standard hourly rate, i.e. from 5:01PM to 7:59AM. The holiday hourly rate follows the holiday schedule in the Rates & Charges section, from 8:00AM to 5:00PM. All hourly rates are computed in accordance with the schedules in the Rates & Charges section

Each additional 25 miles, or part thereof: ½ hour
Extra Stops & Pick Ups
The Carrier will charge 1 hour per stop in addition to actual amount of time spent per stop. Stops and pickups that require toll roads will be billed time and toll charges.
Waiting Time
The carrier will not charge the shipper for the first ten (10) minutes of waiting, for one occurrence during the course of a scheduled move.
11 minutes to 30 minutes ½ hour
31-60 minutes 1 hour
61-90 minutes 1 ½ hour
91-120 minutes 2 hours
The carrier will wait up to 4 hours. After 4 hours of wait time, the move is subject to cancellation. If the move continues after the wait time, hourly moving rates will apply. If the waiting time carries the move over standard business hours, overtime rates will apply for that day.
Toll Charges
The carrier will charge back all tolls to the shipper on the final invoice.

Rates and Charges
Standard Hourly Minimum
A minimum of eight (8) hours, per man, per vehicle will be charged on all moves.
Payment Policy
A 50% deposit of the signed estimate amount is required at the time of scheduling. Payment can be made by cash, certified check, Visa Card, Master Card, American Express card, paypal. There will be a $75.00 charge for any returned check and payment will then be required in cash, money order, or certified check.
Deposits & Refund Policy
A refund of 50% deposit will be returned if a reservation is cancelled within 5 business days of scheduled move. Deposits will not be refunded on cancellations with less than 5 business days’ notice prior to a scheduled move. The Carrier requires written notice at its address of 115 Rt 6. Bldg F Mountainlakes, NJ 07046 via certified mail, return receipt requested, or notification by phone at 732-931-2886, of intent to cancel within 5 business days of a scheduled move (Monday through Friday 9:00AM to 5:00PM Eastern; does not include Saturday, Sunday, or holidays). Cancellations include a change in pick up/move date or destination as well as an actual cancellation. Eviction Enterprises LLC. will issue a cancellation number and only that cancellation number is acknowledgment of a move cancellation. If a Shipper is not provided with a cancellation number, the scheduled move was not cancelled with the Carrier and deposit will not be refunded. The Shipper will receive the assigned cancellation number via email, by a live Eviction Enterprises representative, and via traditional postal mail.

Modern Moving Company Inc. will issue a cancellation number and only that cancellation number is acknowledgment of a move cancellation. If a Shipper is not provided with a cancellation number, the scheduled move was not cancelled with the Carrier and the deposit will not be refunded. The Shipper will receive the assigned cancellation number via email, by a live Modern Moving representative, and via traditional postal mail.
Standard Discounts
The carrier offers a 10% discount on services/hourly rates for senior citizens (65 years old with proof of identification) and military personnel.
Coverage
Option 1: Standard valuation coverage of $0.60 per pound per article.
Option 2: Higher valuation ($0.61 per pound per article and above).
Infestation
The carrier reserves the right to refuse shipment of any household goods infested with ants, termites, cockroaches, bed bugs, or any dangerous or disease bearing insect as a result of the condition of the shipper’s premises, either at the origin or destination.
Fumigation
The carrier reserves the right to charge back the shipper for any and all costs resulting from any necessary fumigation as a result of the condition of the shipper’s premises; fumigation for, but not limited to, infestation of ant, termites, cockroaches, bed bugs, or any dangerous or disease bearing insect.
Impractical Operations
The carrier is not liable for the move, storage, or delivery, when any of the following impede or otherwise make impractical the same: acts of God, including any natural, geological, meteorological occurrence or disaster; any acts of war, declared or undeclared; any civil disturbances, including insurrection, rebellion, riot; any labor dispute, strike, or lockout; any act of state or federal government regarding nationalization, sanction, embargo, or blockade; any act of foreign invasion or hostilities; any act of terrorism; any failure or interruption of public utility or Internet service; severely inclement weather; any inadequate or unsafe road, highway, street, or driveway conditions, or major construction or repair of the same or any major delays or detours arising therefrom; any failure or interruption of ferry, tunnel, or bridge service; any major access obstructions; the presence of any hazardous or dangerous materials; any situation where the moving crew is or might be personally endangered or threatened with physical harm.
Articles: Extraordinary Value
Items of extraordinary value, as defined by contract law, including but not limited to, jewelry, specie, documented antiques of any type, documented artwork of any type, will not be moved and/or stored, unless accompanied by specific proof of insurance for the same.

Upright Pianos: $400.00 per piano, does not include long carry or stairs
Baby Grand Pianos and Organs: $450.00 per piano, does not include long carry or stairs

Pool Tables: $600.00 includes disassembly and reassembly
Articles: Bulky
Utility trailer, pop-up trailer, sail boat, row boat, canoe, skiff, kayak, hot tub, entertainment centers, wall units, bicycles, motorcycles, large toys or play sets, swing sets, jungle gyms, household or commercial safes, will be moved for a set fee of $ 50.00 per bulky item.
Articles: Completely Restricted: Any species of exotic or domestic animals; hazardous materials; explosives; live ammunition; firearms and weapons of any type; any items of extraordinary value will not be moved and/or stored, unless accompanied by specific proof of insurance for the same.
Overnight Hold (Not to Exceed 3 nights): $100.00 for first night; $400.00 for second and third night, per vehicle.
Assembly & Disassembly: Included in hourly rate.
Packing & Unpacking: $75.00 per man per hour plus the cost of materials (bubble wrap, tape, moving blankets, boxes).
Long Carry: First 50 feet included in price of move. 50 feet or more one-time $75.00 charge for the entire move.
Stair Carry: First flight included in price of move (13 steps or less). $75.00 per flight of steps (7 or more steps) for the entire move.
Elevator/Access & Reservation
The carrier will not assume financial responsibility for permit/allowance/use of an elevator. Actual cost of access will be added to the final invoice. Any delays as a result of access or reservation requirements will be charged at the standard hourly rate.
Conditionally Restricted Premises/Access & Reservation
The carrier will not assume financial responsibility for permit/allowance for conditional access. Any delays as a result of conditional access will be charged at the standard hourly rate.

Definitions
Access Fee A fee charged for a shipper to access their goods while in storage.
Also known as a platform fee or handling fee.
Accessorial Services Any service performed during the course of the move, other than actual
transportation of the goods, e.g., packing , unpacking, appliance servicing.
Charges for these services are in addition to transportation costs.
Agent A local moving company authorized to represent and act on behalf of a
national carrier.
Bill of Lading A formal document required by law noting clearly all services and charges
associated with the contracted for move and/or storage.
Breaks Any stoppage of the move that is in control of the mover, not the shipper,
hence also known as scheduled (tariff) break. E.g. coffee break, lunch break,
rest break.
Break Points Numerical points at which the price will be less, if the goods are based on the
next higher unit of weight. Usually determined by a specific unitized table of
points. See Weights and Measures.
Bulky Goods Goods of unusual size and low-weight density, often requiring special
accessorial servicing, with attending extra charges, e.g. boats, snow mobiles,
hot tubs.
Certificate of Insurance See Insurance.
C.O.D. A cash-on-delivery payment, whereby payment in full is required at the time
and location actual delivery.
Commercial Goods Generic term for any goods other than household. Under the Act,
there are three types: household goods, office goods, and special
commodities.They are specifically defined by N.J.S.A. 45:14D-2(k) and
N.J.S.A. 45:14D-2(q), respectively.
Consignee The person or entity to which the goods are to be delivered, usually the
shipper or the shipper’s duly authorized representative.
Consignor The person or entity which delivers the goods. Also referred to as the
mover or licensee or local agent or carrier or hauler.
Coverage Coverage refers to the type of protection selected by the shipper for their
goods, and is not to be confused with the mandatory insurance requirements of a licensee. There are three types under the Act: standard valuation; additional
valuation, and insurance.

Damage Claim A formal statement submitted to the mover by the shipper for damages to
goods alleged to have occurred during the contracted for move. It must be
submitted within ninety days from the date of the move.
Delivery Charges A charge for delivery of packing materials to the point of origin prior to the
move date.
Estimate 1. Binding: an approximation made by the mover of the total cost of the move
and/or storage, based upon a physical survey, to which the mover is bound.
Also known as a flat rate or Not to Exceed Estimate. A formal document
required by law noting clearly all services to be performed and their
respective charged, which is not subject to change.
2. Non-Binding: an approximation made by the mover of the total cost of the
move and/or storage, based upon a physical survey. A formal document
required by law noting clearly all services to be performed and their respective
Charges, which may be subject to change.
Extra Stop Any stop for pickup or delivery of goods, requested by the shipper, in addition
to stops at the point of origin and destination of the contracted for move.
Force Majeure Anything beyond the control of the mover and the shipper which might or
actually does impede the contracted for move and/or storage, e.g. a natural,
meteorological, civil, or military disturbance. This includes roadway type or
construction.
Flight of Stairs Inside a building, the number of stairs leading from one complete floor to
the next complete floor; outside a building, a set of at least ten stairs.
Fuel Surcharge A charge specific to the amount of fuel used by the moving vehicle, usually
as calculated by the travel time between point of origin and point of
destination.
Gross Weight Weight of moving vehicle with all of the contracted for good loaded, there is a
full fuel tank, and all equipment necessary for the move, except the crew, are
also loaded.
Handling In/Handling Out Fee A fee charged for the movement of goods from a moving vehicle into storage, or the removal of the same out of storage to a moving vehicle.
Holidays Any day designated as such by either State or Federal government is a
legal holiday. Any day so designated by a religion is a religious holiday. A
holiday may be a day on which a mover chooses not to offer his services
(“day off”), or it may be a day on which a mover may offer their services but
at a higher rate (“working holiday”). Whichever definition is chosen by a mover
it must be noted clearly.
Household Goods Good normally considered part of a personal dwelling, as distinct from
commercial goods.
Insurance A type of coverage elected by the shipper, the charge and terms of which
are determined by the mover, in conjunction with his insurance carrier. The
carrier offers a particular policy, as the carrier is not licensed to sell insurance,
again, in conjunction with his insurance carrier. A certificate of insurance,
sometimes known as an advice of coverage, is issued to the shipper, stating
in brief the charges and terms of the policy. This is a document separate and
distinct from the estimate, order for service, and bill of lading, and it required
by law.
Inventory A formal schedule of all goods contracted for shipment, which should include
notations on any pre-existing damage respective to each item.

Long Carry An accessorial service provided when goods are at an extended distance
from the actual unloading point of the moving vehicle to the actual
destination, as caused by an obstruction beyond the control of the mover,
e.g., narrow street, unfinished driveway.
Moving Vehicle Any vehicle (van or truck, or any version or combination thereof) duly
registered with the New Jersey Division of Consumer Affairs, and duly
approved and lettered with its assigned license number, used for the
intrastate moving of household goods, commercial goods, or special
commodities.

Net Weight Weight of a moving vehicle as determined by the subtraction of the tare
weight from the gross weight, as determined by official weigh tickets,
issued and signed by a weigh master.
Order for Service A formal document required by law noting clearly the origin and destination
of the move, who is to pay for the cost of the move, with an “Important Notice”
receipt acknowledgment. Once signed by the mover and the shipper it becomes
the contract for the move, based upon a physical survey and non-binding
estimate.
Origin to Destination Travel time as determine from the point of the move where the goods are
loaded to the point of the move where the goods are unloaded. See
Portal to Portal.
Overnight Hold Goods stored on a moving vehicle overnight in lieu of formal storage facility.
PBO Goods packed-by-owner for moving, and noted as such on all documentation.
Packing/Unpacking An accessorial service involving the correct and complete packing and unpacking
of the shipper’s goods by the mover, at the point of origin and point of
destination, respectively, including proper disposal of any materials provided
for that service after their use. See PBO.
Point of Origin Location at which the goods are loaded.
Point of Destination Location at which the goods are unloaded.
Portal-to-Portal Travel time as determined from when the moving vehicle leaves its regular base
to the point of origin, and when the move is completed, from the point of
destination to when the moving vehicle returns to its regular base. This is in
addition to travel time from point of origin to point of destination.
Public Movers Act The Public Movers and Warehousemen Licensing Act (“Act”), N.J.S.A. 45:14D-1
Et seq. is the enabling statute, together with its regulations, N.J.A.C. 13:44D-1
Et seq. for state licensed public movers and warehousemen.
Regular Time Monday through Friday, 8:00AM to 5:00PM. Also known as straight time and
the standard hourly rate.
Special Commodities Under the Act, goods which are classified as neither household goods nor office
goods. See Commercial Goods.
Standard Valuation This type of coverage for consumer goods is the minimum required by State law,
and is calculated at $.60 per pound per article, regardless of the articles original
retail value, current resale value, or its intrinsic or personal worth. Even if
higher valuation coverage has been elected by the shipper, if the cost of the
damages is less than the stated deductible, standard valuation if applied as it
is always in effect. Standard valuation is a limitation of the mover’s liability for
cargo damage, rather than a coverage policy per se. There is never any cost to
the shipper for this type of coverage. This type of coverage must be duly noted
on the estimate, order for service, and the bill of lading. Standard valuation is
also known as statutory minimum liability, standard release rate, release value,
and basic value. NOTE 1: Poundage may be determined by: (1) cube formula;
(2) actual weighing of the article in question on a State certified scale; or
(3) by using the Joint Military/Industrial Table of Weights and Depreciation
guide.
Storage The action or method of storing something for future use
Tare Weight Weight of an unloaded moving vehicle, with a full fuel tank and all equipment
necessary for the contracted move, without drive and crew on board, prior to
formal weighing at a State certified scale.
Third Party A person or entity, other than the mover, who provides services requested by
the shipper, through an arrangement with the mover. A third party lacking its
own license, must provide its service formally under the authority of the
licensed mover, i.e., it must receive payment from the mover, as it cannot
charge the shipper directly.
Travel Time The time required by a moving vehicle to proceed from the point of origin to
the point of destination. See Portal to Portal.
Valuation This type of coverage is elected by the shipper, who declares a particular
value on the entire shipment, or more often, on selected articles of a shipment,
usually of an extraordinary resale or intrinsic value. The charges and terms for
this type of coverage are separate from other charges and terms pertaining to
the contracted for move, which are determined by the mover. This type of
coverage must be duly noted on the order for service and the bill of lading. This
type of coverage is optional for the mover, as it is not mandated by either
statute or regulation. Valuation is also known as additional valuation, higher
valuation, declared value, or declared valuation.
Weight & Mileage A method of cost computation usually reserved for long distance moves,
generally considered to be in excess of fifty miles. Determination is by mileage
between origin and destination, times the weight of the goods, as verified by
weight tickets, and measured by a table of break points. Cubic measurement
may also be applied in lieu of actual weight of the moving vehicle and the goods
to be shipped.
Weigh Ticket A machine printed ticket produced by a State certified scale, and signed by a
duly authorized Weigh Master as verification. Such a ticket denotes the tare
weight and the gross weight of a given vehicle
